Cyberspace HQ gets injunction against FluidPoint, Inc., Aaron Hollingsworth and Chris Barnes.

Canoga Park, CA (March 3, 2000) - A U.S. district court issued a preliminary injunction against defendants FluidPoint, Inc., Aaron Hollingsworth and Chris Barnes, forcing them to cease all distribution, sale and updating of its FluidPromotion software.  United States District Court Judge Ronald S.W. Lew ruled that Cyberspace HQ is highly likely to prevail on the merits of its case for copyright infringement and misappropriation of trade secrets.  Although not reached at the preliminary injunction phase, Cyberspace's suit also alleges breach of confidentiality and unfair competition. In its suit, filed by Daniel E. Engel, Esq., Cyberspace HQ alleges that FluidPromotion infringes on the copyright of its popular website submission software, AddWeb Website Promoter and was created by Hollingsworth and Barnes by using highly confidential trade secrets they obtained while employed by Cyberspace HQ.  No date for the trial has been set yet.  At the trial Cyberspace HQ will ask for a permanent injunction against FluidPoint, as well as monetary damages and recovery of attorneys fees.

FluidPoint, Inc. is a Delaware corporation that was formed by former Cyberspace HQ employees Aaron Hollingsworth and Christopher Barnes.  Hollingsworth was the lead programmer on the AddWeb Version 3.0 project, and had been employed by Cyberspace HQ for roughly one year.  Barnes was employed by Cyberspace for six months. 

FluidPoint released FluidPromotion only six months after Hollingsworth and Barnes left Cyberspace HQ.  According to HollingsworthÂ’s sworn statement filed in the case, he and Barnes developed Fluidpromotion in just five weeks.
